Overview

A trademark protects the name, logo or mark that customers use to identify your business. Registration gives you the exclusive right to use it for the goods or services in your class, and a basis to act against imitators.

The most common mistake is filing without a proper clearance search. A mark that is deceptively similar to an existing registration will draw an objection or an opposition, and by then you may already have printed packaging and built a website around it.

We search before we file, choose the class that matches what you actually sell, and stay with the application through examination. Objection replies and hearing representation are available as a continuing scope.

How it works

  1. Clearance search — Existing and pending marks reviewed for conflicts before you commit.
  2. Class and drafting — Correct class chosen and the specification drafted precisely.
  3. Filing — Application filed with IP India; you may use the ™ symbol from this point.
  4. Examination — Report reviewed and, where required, an objection reply filed.
  5. Registration — Certificate issued, after which the ® symbol may be used.

Typical timeline. Twelve to twenty-four months to registration where the mark is unopposed. The ™ symbol may be used from the filing date.

Questions about Trademark Registration

When can I use the ™ and ® symbols?

You may use ™ as soon as the application is filed. The ® symbol may only be used after the certificate of registration is granted — using it earlier is itself an offence.

What happens if my application is objected to?

You receive an examination report setting out the grounds. A written reply must be filed within the prescribed period, and a hearing may follow. Many objections are answerable; the strength of the reply matters, which is why the drafting is not a formality.

How many classes do I need?

One application covers one class. If you sell across categories — say a food product and a restaurant service — you may need more than one. We advise on this before filing rather than after.

Does an Indian trademark protect me abroad?

No. Trademark rights are territorial. An Indian registration can, however, serve as the basis for international filings under the Madrid Protocol.
